A Covington County judge has ordered state officials not to spend $38 million from the sale and lease of local school lands, pending a Tuesday hearing. The move raises new doubts that the disputed cash will be available to prevent statewide school budget cuts in coming weeks, even as the Nov. 5 election draws near.
The Covington County school board filed suit Aug. 21 in Andalusia saying the $38 million doesn’t belong to the state, that it’s unconstitutional to spend it, and that a bond sale to pay back local boards might never go through because of the illegality of spending the school land money.
